N.C. Court of Appeals Opinions for March 15, 2016

The North Carolina Court of Appeals released a batch of opinions today:

Bennett v. Hospice & Palliative Care Ctr. Of Alamance-Caswell  (15-667). Medical malpractice; N.C. R. Civ. P. 9(j); loss of sepulcher, breach of contract are not “medical malpractice” claims
Blackburn v. NC Dep’t Of Pub. Safety  (15-556). Career state employee; Just cause for termination; Sufficiency of notice
Boyd v. Rekuc  (15-780). Rule 9(j), medical malpractice, voluntary dismissal, statue of limitations

State v. Blue  (15-837). Fourth amendment search. Satellite based monitoring for sex offenders is a Fourth Amendment search and must be reasonable.
State v Cook  (15-278). ineffective assistance of counsel, State v. Harbison, state of mind hearsay exception
State v. Hurd  (15-588). Batson; Reverse Batson; Peremptory Challenge; Grossy Improper Closing Argument.

State v McLaughlin  (15-333). Confrontation clause, child sexual abuse, declarant unavailable, medical diagnosis hearsay exception, excited utterance exception
State v. Miller  (15-636). Pseudoephedrine possession; due process; strict liability; notice
State v. Morris  (15-846). Fourth amendment search.  Satellite based monitoring for sex offenders is a Fourth Amendment search and must be reasonable.
