Trademark: USPTO 2025 Fee Hikes

The USPTO is raising its trademark-related fees beginning January 15, 2025.

TL;DR: Anyone considering filing a trademark application should assess whether the new fees will apply to them. If so, they could consider filing before January 15, to save on fees. Also, Trademark Registration holders who need to submit maintenance documents, should do so before January 15 to save on filing fees.

New Application-Related Fees

The PTO is adding new fees to this mix for applications submitted after January 15, 2025.

These new fees will be charged, where applicable in addition to the application fee. These new fees include :

  • a $100 per class insufficient information fee,
  • a $200 per class bespoke descriptions fee and
  • a $200 per class long descriptions fee (for any class where the description of goods and services exceeds 1,000 characters).

For many applicants the most relevant of the above new fees will be the bespoke description fee. For trademark owners who need their registration to cover a product or service that the USPTO doesn’t already have a ready-made description for, the fees for their application fees will effectively jump from $350 per class to $550 per class.

This will likely affect niche industries and industries with new or novel technologies, services or products. It will also make it more costly to use goods and services descriptions to distinguish an applicant’s goods from those of a live registration or prior-filed application for the purposes of avoiding confusion.

Intent-to-use applications

The PTO is also raising fees for statements of use which are required for applications filed on a basis of intent-to-use. The current fee is $100 per class This new fee will be $150 per class.

Maintenance Fees

The PTO is raising the fees for registration renewals and maintenance by $25 to $100 per class depending on the applicable filing. See below:

Additional Notable Changes

Another significant change is the retirement of the TEAS Plus application, replaced by a single base application structure to which the updated fees will apply. This change means that all new trademark applications will now incur a minimum filing fee of $350 per class.

Also, noteworthy is the fact that all new applications must now be submitted through the “Trademark Center,” which transitioned from its beta phase to an official release on January 18th.
