Why Every Creator Needs an AI Policy for Their Team

As artificial intelligence tools become increasingly integrated into creative workflows, content creators face a growing need to formalize their internal practices.

Even when AI-generated content doesn’t appear in the final product (and the prevailing sentiment among creators generally leans against its use in finished work) most creators or their teams are leveraging AI tools at some stage of the creative process.

Professional creators operate as production companies, managing collaborators, freelancers and complex workflows that often include scripting, editing, animation, design, voiceover, captioning, and more. With that structure comes increased responsibility, and potential legal exposure. When anyone on the team misuses an AI tool, intentionally or not, the consequences often fall on the creator at the center of the brand.

An internal AI policy offers creators clarity, consistency, and protection. It sets expectations across a team, helps manage legal risk, and signals professionalism to sponsors, platforms, and collaborators.

Why AI Governance Matters for Content Creators

1. Creators carry responsibility for their teams’ AI use.
Many creators operate with distributed teams of editors, writers, or assistants. Even when these collaborators are hired as freelancers, the creator remains accountable for how AI is used under their banner.

Misuse, whether it’s unauthorized use of client data, copyright infringement, or relying on inaccurate outputs, can expose the creator to legal or reputational harm.

2. AI mistakes reflect directly on the creator’s brand and expose them to liability.
Tools like AI chatbots or image generators are known to “hallucinate,” plagiarize, or embed bias into outputs. The use of AI for voice or image generation may also result in the inadvertent infringement of someone else’s IP or publicity rights.

If inaccurate, unethical, or infringing content is published it is the creator, not the tool, who will be held accountable by audiences, sponsors and platforms.

Unless negotiated otherwise, most AI tools have terms of service that expressly disclaim all liability on their end for any resulting harm.

Without clear internal guardrails, the line between creative experimentation and legal or reputational exposure can become dangerously thin.

3. Use of AI tools presents multiple risks to Intellectual property and confidential information.
Many AI platforms retain rights to use uploaded materials to train future models. Creators who feed drafts, visuals, or voice samples into these systems may inadvertently lose control over their own IP and information that should be kept confidential (this could also put them in breach of endorsement agreements).

Additionally, not all content created using AI tools is eligible for copyright protection. In its Second Report on Copyright and AI, issued at the beginning of this year, the US Copyright Office stated that content created using AI may be eligible for copyright protection if there is enough human involvement. However, the threshold for how much human involvement is necessary to render a work protectible remains uncertain.

For most creators, having enforceable IP rights in their content is crucial. An internal policy can guide team members in documenting the human involvement in creation process and prevent them from unintentionally compromising valuable creative assets.

4. Sponsors and platforms are beginning to demand transparency.
As AI-generated content becomes more common, sponsors and collaborators increasingly want to know how content is created, and whether it complies with ethical and legal standards. Having an internal AI policy demonstrates that a creator has considered these issues and has mechanisms in place to mitigate risk.

What a Creator-Focused AI Policy Should Include

A well-drafted policy does not need to be overly complex, but it should address key areas relevant to modern creative production. Among the most important components:

Define what the policy means by AI.
The policy should explain, in plain language, what tools and technologies are covered. Common examples include AI chatbots, image generators, voice synthesis tools, auto-captioning software, and AI-driven editing tools.

List approved tools and use cases.
The policy should include a list of pre-approved AI tools, what tasks they may be used for (e.g., brainstorming, draft scripting, thumbnail generation), and which uses are off-limits (e.g., final outputs without human review, anything involving client data, likeness or voice replication without consent). For example, if an endorsement agreement includes a rep or warranty that the creator’s content is not in the public domain or that they hold exclusive rights to it, it’s wise to avoid using AI generators to create that content.

Protect confidentiality.
All collaborators should be prohibited from entering sensitive, proprietary, or unpublished content into third-party AI platforms. This includes scripts, pitches, personal data, or client information, materials or deliverables.

The policy should make clear that once content is input into an AI tool, the creator may lose control over it.

A word about AI notetakers: proceed with caution.

Using AI-powered notetakers in meetings may seem convenient, but it raises a host of legal and practical risks.

First, these tools can compromise the confidentiality and proprietary nature of the information discussed, particularly if the data is stored or processed by third-party vendors.

Second, recording a meeting, whether through audio, video, or transcription, may violate federal or state wiretapping laws if proper notice isn’t given and consent obtained. While some states require only one-party consent, others mandate that all participants be informed and agree in advance.

Additionally, if the AI tool performs any form of analysis involving biometric data (such as voice recognition or speaker identification), it could trigger further compliance obligations under privacy laws that treat biometric data as sensitive, such as the Illinois Biometric Information Privacy Act (BIPA), the California Consumer Privacy Act (CCPA/CPRA), and the GDPR.

Creators who opt to use AI notetakers should have policies that address notice and consent requirements, data security protocols, and limitations on how and when these tools may be used.

Check before trusting AI outputs.
Given that AI outputs may be unreliable, the policy should require human review of all AI-generated content before it is published. The goal is to prevent errors, bias, and potential liability stemming from overreliance on automated outputs.

Protect intellectual property.
The policy should reinforce that AI tools cannot be used to replicate or remix third-party content without permission and should ban plagiarism or passing off AI work as purely human. It should also clarify when and how creators or team members must disclose the use of AI.

Additionally it should require those using AI tools in the creation of content to document the entire creation process, the prompts used, and any editing of outputs in case it becomes necessary to demonstrate the extent of human involvement.

Check for bias and keep a human in the loop.
Several laws in the US and abroad regulate the use of AI systems to make decisions that have legal or other significant effects on people. If AI tools are being used for decisions that affect people, such as casting, hiring, community moderation, or the awarding of promotion prizes, the policy should mandate human oversight and regular review.

Even with human oversight, some laws require companies to substantiate the reasoning behind AI-assisted decisions, provide an appeals process, and conduct impact assessments before deploying such tools.

Tools that influence employment decisions may carry additional legal obligations and potential liability under anti-discrimination and labor laws.

Have a process for evaluating new tools.
Given the pace of AI development, the policy should include a simple procedure for requesting approval to use new platforms. This helps the team stay agile without compromising on control or risk management.

Training and implementation.
Everyone on the team should get basic training on what the AI policy covers, how to use the tools safely, and what to watch out for.

Creators should designate a point person, often the creator themselves or a trusted team lead, to answer questions, review tool requests, and ensure compliance. Establishing a shared inbox or dedicated Slack channel is often sufficient for managing internal questions.

Update often.
AI is evolving daily. The policy should include a commitment to regular updates and refresher training. Team members should be encouraged to review the latest version of the policy before starting any new AI-related projects.

Final Thoughts

AI tools can supercharge the creative process, but only if used thoughtfully. Without proper oversight, their use can lead to missteps that undermine trust, creative integrity, and brand value. A strong internal AI policy is the best defense against creative confusion, copyright risks, brand-damaging mistakes, and potential liability.

AI policies don’t have to be long or filled with legal speak. They should be clear, practical, and tailored to the creator’s workflow. A well-crafted AI usage policy is the foundation for building a culture of responsible, informed, and ethical AI use.
